What an eSIM Plan Is — and Is Not
Introduction
These Terms and Conditions constitute a legally binding agreement (“Agreement”) made between you and Wissen & Wohlstand GmbH Slowakei s. r. o., with registered office at Lermontovova 3, 811 05 Bratislava, Slovakia, European Union (“travelData.shop”, the “Company”, “we”, “us”, or “our”), concerning your access to and use of our website, web platform, mobile applications (if any), and related services (collectively, the “Platform”). You agree that by accessing the Platform, you have read, understood, and agree to be bound by all of these Terms and Conditions.
IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms or documents posted on the Platform form part of these Terms. We may change these Terms — to reflect a change in the Service, in our Partners or in the law, or to correct or clarify them. Every version is dated at the foot of this page, and a change takes effect when it is published there.
Where a change materially reduces your rights or increases your obligations, we will tell you before it takes effect — by eMail to the address on your account, or on the Platform where you do not have one — and you may close your account if you do not accept it. Continuing to use the Platform after a change takes effect means you accept it. A change never applies retroactively: a plan you have already bought keeps the terms that applied when you bought it.
The service provided by the Platform is not intended for use by any person or entity in any jurisdiction or country where such use would be contrary to law or regulation. Accordingly, those persons who choose to access the Platform from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
1. eSIM Service
travelData.shop sells prepaid eSIMs and/or prepaid digital connectivity plans based on eSIM technology (the “Service”). We may provide the Service directly and/or as a reseller, distributor, marketplace operator, or agent through one or more third-party telecommunications providers, network operators, aggregators, partners, or agents (collectively, “Partners”).
You acknowledge and agree that the underlying mobile connectivity, coverage, network quality, routing, and service availability are provided by Partners and their network operators and may vary by destination, device, and local conditions.
2. Eligibility and Age
You may use the Platform and purchase the Service only if you are at least 18 years old, have reached the age of majority under the law of your country of residence, and are legally capable of entering into a binding contract. Where these Terms refer to the age of 18, that age applies regardless of a lower age of majority where you live. If you are a minor, you may use the Platform only with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using the Platform you represent that you are not located in, and are not a resident of, a country or territory subject to sanctions or embargoes that prohibit the Service, and that you are not listed on any restricted-party list. We may refuse or cancel an order where this representation is untrue.
3. Terms of Service
3.1. Registration
You may register for the Service through the travelData.shop Platform or via our authorized partners, agents, or channels (if any).
You must provide your first and last name and a verifiable email address to register. Additionally, you may upload a profile photo and state travel preferences. Such information is optional and may be provided voluntarily.
To register for, access, or use the Service you must accept these Terms and Conditions and our Privacy Policy.
3.2. Purchase and Activation
We may restrict the availability of plans in certain countries or regions, or for certain devices, due to technical, commercial, regulatory, or partner limitations. You can browse, select, and purchase plans on the travelData.shop Platform or via our authorized partners and agents.
By purchasing the Service, you acknowledge that you have an unlocked, eSIM-compatible device, which is a prerequisite for the Service. Device compatibility is your responsibility. We do not guarantee that any specific device, operating system version, firmware, or carrier configuration will support the Service in all cases.
Upon purchase, you must download and install the eSIM profile onto your device in order for the data plan(s) to be configured as per your order. The downloaded eSIM profile may remain on your device after data has been consumed or your plan has expired. You may remove the eSIM in your device settings at any time; however, we recommend that you do not remove the eSIM until your plan has been depleted or expired, as removing it may prevent continued use of the Service and may affect troubleshooting or plan management.
To use the Service, you must first download/install the eSIM and then activate the data plan attached to the eSIM for service to commence. Downloading and activation may require a stable internet connection and may depend on partner systems and local network conditions.
Your order is an offer to buy. The contract between us is concluded when we accept that offer by confirming the order and making the eSIM available to you, which is normally within seconds of payment; the confirmation is sent to the email address on your account and is also available in your account, and it records what you bought, what you paid and the plan terms that applied. Displaying a plan on the Platform is an invitation to buy it, not an offer, and we may decline an order — for example where a plan has been withdrawn, a destination has become unavailable, a price was shown in error, or section 2.2 or section 10.3 is not satisfied.
Where payment has been taken and the eSIM has not reached you, the contract is not performed and the obligation is ours to close. We will keep trying to provision the plan and, where we cannot, we will refund the order in full without you having to ask. The Refund Policy states the time by which you should expect the eSIM and what to do if it has not arrived.
3.3. Duration and Termination
The Service shall commence immediately following a successful download/installation of the eSIM and activation of the data plan associated with the eSIM, subject to network availability and partner provisioning.
The duration and validity of the Service will be as per the terms of the plan purchased (including any data cap, speed policy, fair use policy, validity period, and geographic coverage).
The Service will terminate either upon full consumption of the plan’s included data (or exhaustion of applicable allowances) or upon expiry of the plan validity period, whichever is earlier.
We may suspend or terminate your use of the Service in case of breach of your obligations set out below, with or without notice. We reserve the right to close account(s) of any customer and to request proper payment or take appropriate action if a customer attempts to use credits, promotions, vouchers, referrals, discounts, or rewards in a questionable manner, abuses any promotional program (the “Program”), breaches these Terms & Conditions, or violates any applicable law, statute, or governmental regulation.
Where a charge you authorised under section 6 does not go through — a renewal or the conversion of a free trial — we may suspend the eSIM it relates to until payment succeeds. This is not a sanction and does not require any fault on your part: an off-session charge cannot present a bank’s security challenge, so it can fail for a card that is in good standing. We will tell you by email and give you a way to complete the payment, and the plan resumes for the remainder of its validity once it succeeds. Where payment is not completed, the plan ends under section 3.3.3 and no further charge is made.
3.4. Engagement
The Service is provided on an “as is” and “as available” basis. We shall use reasonable efforts to make the Service available to you, contingent upon our and/or our partners’ ability to maintain network capacity and connection availability. However, because we rely on technology, networks, and systems provided by Partners, we cannot guarantee network coverage, speed, latency, quality, uninterrupted availability, or performance of the Service in any location.
Two different companies stand behind a plan, and we treat them differently. The mobile network your eSIM actually roams on is named on the plan page, because it is what decides whether the plan works where you are going; where a plan can use more than one network in a country, they are listed there. The wholesale partner we buy the plan from is commercially confidential and is not named — in this document or anywhere else — and nothing here obliges us to identify it. That confidentiality does not override data-protection law: where you ask us who has received your personal data, we answer under the Privacy Policy, naming the recipient or its category as that law requires. You agree that you may also be subject to the acceptable use and fair use policies of the networks carrying your traffic.
Availability of the Service depends on Partners’ ability to maintain network capacity and connection availability, for which there are no guarantees.
3.5. Customer Obligations
You agree to use the Service in compliance with these Terms and Conditions and you are responsible for all use of the Service through your account and device(s).
You agree to submit true, accurate, and complete registration information and to keep such information up-to-date.
You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is objectionable, misleading, infringes rights, or violates these Terms.
You agree to use the Service in accordance with all applicable laws and regulations of your home nation, your country of residence, and any country in which you are present while using the Service.
Unless expressly agreed otherwise in writing, you agree that the Service is for personal use and personal consumption only and may not be resold, sublicensed, or commercially exploited.
You agree that the Service shall not be used to engage in any action that is abusive, illegal, fraudulent, or that causes the network, partners’ systems, or the Service to be impaired or damaged, including (without limitation) attempts to bypass limitations, manipulate provisioning, misuse roaming, engage in unlawful content distribution, or conduct activities that violate acceptable use policies.
You agree that any credits, promotions, referrals, discounts, or rewards (the “Program”) shall not be used to undermine the fairness, integrity, or legitimate operation of the Program, including (without limitation) creating fake accounts, using fictitious identities, or attempting to obtain rewards improperly. We, in our sole discretion, reserve the right to disqualify you from the Program and/or future use of our Services.
You agree that we may suspend the Service in case of breach of the above obligations and that you will remain liable for all charges due under these Terms in respect of the suspended Services. Any attempt to deliberately damage or undermine the legitimate operation of the Service or the Program may be in violation of criminal and civil laws. We reserve the right to seek remedies and damages (including legal fees) to the fullest extent permitted by law, including reporting suspected unlawful activity to relevant authorities where appropriate.
4. Service Limits
The Service provides mobile data connectivity. Voice calling, SMS or MMS messaging and a telephone number are included only where the plan page expressly states so; all other plans are data only. The scope, destinations and allowances of any voice or SMS component are those stated on the plan.
Emergency services (such as 112, 911 or local equivalents) cannot be reached through the eSIM, including on plans that include voice calling. You are responsible for keeping an alternative means of contacting emergency services, such as your primary SIM.
Speeds, coverage, latency and network availability are not guaranteed. They depend on the local network operators, your device, your location, congestion and any fair use or speed policy stated on the plan.
When the data allowance included in a plan is used up, connectivity stops or is reduced to the speed stated on the plan. Unused data is not carried over after the validity period ends. To continue, you may top up where the plan allows it or purchase a new plan.
Some destinations require identity registration by law before a plan can be used. Where this applies, it is stated on the plan page, and the plan cannot be activated until registration is complete. Failure to register is not a technical fault attributable to travelData.shop.
Data use is measured by the network operator carrying the traffic, and that measurement is the one that decides how much of your allowance remains. We do not meter the connection ourselves — we receive the operator’s figure through our Partner and show it to you, so the usage displayed in your account can lag actual use, and a session in progress may not be counted until it ends. Where you believe a figure is wrong, tell us under section 29 and we will ask the operator to check it.
5. Payment Terms
You may register and purchase eSIM plans on the travelData.shop Platform. Payment may be processed by us and/or through authorized third-party payment processors, payment service providers, or agents.
All eSIM plans are prepaid. Prices may be shown inclusive of taxes or exclusive of taxes depending on your location and applicable law, and this may be indicated at checkout. Taxes (if applicable) may be calculated based on the billing information you provide and/or other legally required location signals.
“Indirect Taxes” means sales tax, value-added tax (VAT), GST, and any similar levies or taxes imposed by government entities at the time of sale of Plans.
If you believe a charge is wrong, tell us first. A chargeback raised with your bank takes weeks, and while it is open we cannot refund the same charge ourselves — almost every case is settled faster through support, and section 8 and the Refund Policy set out what you are entitled to. While a chargeback is open, we may pause the eSIMs and top-ups that charge paid for, stop automatic payments on your account, and take back the travelData Coins or block the gift card it bought; if your bank decides in our favour, all of it is restored. Where a chargeback is raised for a plan that was delivered and worked, we will give your bank the technical record for the eSIM. If it succeeds regardless, the paused eSIMs stay stopped where the network allows it, we may close your account, and we may recover the amount and any fee the bank charged us. Raising a chargeback for a plan you used is not a route to a refund; it is a reversal of a payment for a service you received.
6. Auto-Renewal and Deferred Charges
Where you enable automatic renewal for a plan, you authorise us to charge the payment method saved to your account for the same plan at the price displayed when renewal was enabled, at the moment the current plan terminates under section 3.3.3. We will notify you by email before each renewal charge. You may disable automatic renewal at any time in your account before the renewal takes place, and no further charge will be made.
Where we offer a free trial that converts into a paid plan, the plan, price and conversion date are stated on the trial offer and in your account. You authorise us to charge the saved payment method on the conversion date unless you cancel the trial before then. We will notify you by email before the conversion. Cancelling does not end the trial early.
Where either charge does not go through, we will tell you by email and give you a way to complete it, and the eSIM concerned may be suspended in the meantime under section 3.3.5. We do not retry indefinitely, we do not charge a fee for a failed payment, and where payment is not completed the plan simply ends under section 3.3.3.
7. Gift Cards, Coins and Credits
travelData Coins — written “tDC” here and in the Refund Policy — are the balance held in your account. Gift cards, travelData Coins, referral rewards and promotional credits are not money, do not earn interest and, except where mandatory law provides otherwise, cannot be exchanged for cash, transferred to another account or used outside the Platform. They are applied at checkout against the price of a plan. A gift card is not refundable once it has been issued: it is prepaid value that has already been delivered, in the same way a plan is.
Where a purchase paid partly with tDC or credit is refunded under section 8, each part goes back where it came from: the tDC to your balance, the money to the payment method you paid with. Money refunded to you is paid in money — that is your entitlement and we cannot substitute tDC for it. You may choose to take a money refund as tDC instead, and some people do because it is credited in days rather than waiting on a bank; choosing it is yours alone and we never make it a condition. Rewards and credits obtained in breach of section 3.5.7 may be cancelled.
A referral reward is earned when a person you referred completes a purchase that is not subsequently refunded or charged back, and it is credited to your Coins balance once that purchase is beyond the refund window. Referring yourself, a second account of your own, or an account created for the purpose does not earn a reward. Where a referred purchase is later refunded or reversed, the reward for it is withdrawn.
The referral programme, promotional campaigns, reward tiers and the rate at which Coins are earned are not part of the plan you buy. We may change them or end them for the future, and we will publish the change before it takes effect. Coins already credited to your balance are not withdrawn by such a change, and a plan you have already bought is unaffected by it.
Badges, challenges, streaks, travel statistics, reward tiers and leaderboards are a free feature of the Platform. They carry no monetary value except where a challenge expressly awards Coins, in which case those Coins are governed by this section. A leaderboard shows the display name and standing of the accounts on it; if you would rather not appear, you can leave it from your account. We may add, change, reset or withdraw any of these features, and we may exclude an account from them where section 3.5.7 has been breached.
When your account is closed, any remaining tDC, promotional credit and unredeemed reward balance are cancelled and are not paid out, except where mandatory law provides otherwise or where we closed the account for a reason that is not your breach — in which case section 23 applies. Spend or use them before you close the account. A gift card that has not been redeemed keeps its own validity and can still be used on another account. Closing an account does not erase the orders behind it: invoices are a legal record and are kept for the period the Privacy Policy states.
8. Returns and Refunds Policy
Customers will be charged upon purchase of the eSIM plan.
An eSIM plan is digital content. It is delivered the moment the eSIM profile and its QR code reach your account and your email, which happens within seconds of payment — not when you install or activate it. By accepting these Terms at checkout and completing the purchase you expressly request that we begin delivering the plan immediately, and you acknowledge that once it has been delivered you lose any right of withdrawal or cooling-off period that would otherwise apply to a purchase made at a distance.
A plan that does not conform to its description is refunded, whether or not you have activated it: it does not connect at all in a covered destination on a compatible device, it stops working through no fault of yours, or it was not what the plan page said it was. We will first try to repair the fault or replace the eSIM. Where that is not possible or does not solve the problem within a reasonable time, you are entitled to a refund proportionate to the part of the service you could not use, or to a full refund where the plan never worked.
A plan that connects and delivers data as described is not refunded, however much of it you used or whether you used it at all. Where a plan has not been activated and we are able to cancel it at the network so that it can no longer be used, we may agree to a refund or an exchange as a gesture rather than as an entitlement; whether that is possible depends on the plan, and the answer may be no.
Orders we fail to deliver, purchases containing more than one eSIM, top-ups, gift cards and Coins, auto-renewal and trial charges, duplicate or incorrect charges, purchases you did not make, purchases billed by the App Store or Google Play, request deadlines and processing times are all governed by the Refund Policy, which forms part of these Terms. Where it gives you less than the mandatory consumer law of your country of residence, that law applies instead.
Any complaints or feedback about the Service can be sent to our support team through the contact form on the Platform. The full route is set out in section 29 and in the Refund Policy.
9. Business Use
The Service under these Terms is intended for personal, non-commercial use, which is why section 3.5.5 prohibits reselling it or exploiting it commercially. Buying on behalf of a business, for employees or customers, or in volume is a different transaction and is governed by a separate business agreement between us and that business.
Until a business agreement has been agreed between us, a business purchase is governed by these Terms and the Refund Policy in full, except that rights these Terms give you as a consumer are consumer rights and do not extend to a business. Ask us through the contact form for the current business terms before placing an order of that kind.
10. Governing Law and Legal Compliance
This Agreement and any non-contractual obligations arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Slovak Republic and applicable European Union legislation, and any dispute shall be submitted to the competent courts of the Slovak Republic, unless mandatory consumer protection laws provide otherwise.
Other mandatory rules, regulations, and laws of other states or countries may also apply to your use of the Services, including mandatory consumer, telecom, sanctions, export controls, and data protection laws.
We may be required to collect certain personal information from you in order to comply with legal and regulatory requirements (including fraud prevention, payment compliance, sanctions screening, tax requirements, or telecom-related obligations). If we request such information from you and indicate that this is for legal or regulatory compliance, then you agree that you will provide true and accurate information. Our use of your personal information is subject to our Privacy Policy.
These Terms are published in several languages for your convenience. The English version is the original and is the one that governs: where a translation differs from it, whether through a translation error or because a translation has not yet caught up with a change, the English version prevails. This does not affect any right you have under mandatory law to be given contract terms in your own language.
11. Intellectual Property Rights
Except as otherwise indicated, the Platform is our proprietary property and all source code, databases, functionality, software, website designs, user interface elements, audio, video, text, photographs, and graphics on the Platform (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of applicable jurisdictions and international conventions. The Content and the Marks are provided on the Platform “AS IS” for your information and personal use only. Except as expressly provided in these Terms and Conditions, no part of the Platform and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
If you are eligible to use the Platform, you are granted a limited license to access and use the Platform and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Platform, Content, and the Marks.
12. Privacy Policy
We take our customers’ privacy seriously. What we do with your personal data is set out in the Privacy Policy, which is given under data-protection law and is read alongside these Terms. It is information rather than a term you agree to: your rights under it do not depend on accepting these Terms, and accepting these Terms is not a consent to anything described in it. Where these Terms and the Privacy Policy describe the same processing, the Privacy Policy is the one that governs it.
Please note that we operate globally and may use service providers and infrastructure located in different countries. Accordingly, your information may be transferred to and processed in countries other than your country of residence, subject to applicable data protection laws and safeguards.
We may be compelled to disclose personal details where required by a valid order of a competent governmental authority or court, or where disclosure is otherwise required by law. By registering for the Services you acknowledge that such disclosures may occur when legally required.
13. User Generated Contributions
The Platform may invite you to chat, contribute to, or participate in blogs, message boards, online forums, reviews, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Platform, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, “Contributions”). Contributions may be viewable by other users of the Platform and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary.
When you create or make available any Contributions, you thereby represent and warrant that:
- The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights of any third party, including but not limited to copyright, patent, trademark, trade secret, or moral rights.
- You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Platform, and other users of the Platform to use your Contributions in any manner contemplated by the Platform and these Terms and Conditions.
- You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Platform and these Terms and Conditions.
- Your Contributions are not false, inaccurate, or misleading.
- Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
- Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).
- Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
- Your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another.
- Your Contributions do not violate any applicable law, regulation, or rule.
- Your Contributions do not violate the privacy or publicity rights of any third party.
- Your Contributions do not contain any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner.
- Your Contributions do not violate any laws concerning child sexual abuse material (CSAM) or child pornography, or otherwise intended to protect the health or well-being of minors.
- Your Contributions do not include any offensive comments that are connected to protected characteristics where prohibited by law, including race, national origin, gender, sexual orientation, disability, or other protected status.
- Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms and Conditions, or any applicable law or regulation.
Any use of the Platform in violation of the foregoing violates these Terms and Conditions and may result in, among other things, termination or suspension of your rights to use the Platform.
14. Contribution License
By posting your Contributions to any part of the Platform, or making Contributions accessible to the Platform by linking your account from the Platform to any of your social networking accounts, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, reproduce, disclose, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for the purpose of operating, marketing, improving, and providing the Platform and related services, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sub-licenses of the foregoing.
This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, username, profile image, and any trademarks or trade names you provide in connection with your Contributions. You waive all moral rights in your Contributions to the extent permitted by law, and you warrant that moral rights have not otherwise been asserted in your Contributions.
We do not assert any ownership over your Contributions. You retain ownership of your Contributions and any intellectual property rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Platform. You are solely responsible for your Contributions to the Platform and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions, except where such limitation is not permitted by law.
We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Platform; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.
15. Guidelines for Reviews
We may provide you areas on the Platform to leave reviews or ratings. When posting a review, you must comply with the following criteria:
- you should have firsthand experience with the person/entity or service being reviewed;
- your reviews should not contain offensive profanity, abusive, racist, hateful, or otherwise unlawful language;
- your reviews should not contain discriminatory references where prohibited by law;
- your reviews should not contain references to illegal activity or instructions to commit wrongdoing;
- you should not be affiliated with competitors if posting reviews intended to manipulate perception;
- you should not make false statements or misleading claims;
- you may not post any false or misleading statements;
- you may not organize a campaign encouraging others to post reviews, whether positive or negative, in a manipulative or deceptive manner.
We may accept, reject, or remove reviews in our sole discretion. We have no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sub-licensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.

16.2. Apple and Android Devices
If you access the Platform through a mobile application downloaded from the Apple App Store or Google Play (each an “App Distributor”), the following terms apply: (1) the license granted to you for the application is limited to a non-transferable license to use the application on a device that utilizes iOS or Android, as applicable, and in accordance with the App Distributor’s terms; (2) we are responsible for providing maintenance and support services for the application as required by applicable law; (3) in the event of any failure of the application to conform to an applicable warranty, you may notify the App Distributor, and the App Distributor may refund the purchase price (if any) in accordance with its policies; (4) you represent and warrant that you are not located in a country subject to applicable embargoes or sanctions that prohibit access to the Platform, and that you are not on any prohibited or restricted parties list; (5) you must comply with applicable third-party terms when using the application; and (6) you acknowledge and agree that the App Distributors are third-party beneficiaries of these Terms with respect to the mobile application and may enforce them.

We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions to the extent permitted by law, and you hereby warrant that any such Submissions are original with you or that you have the right to submit them. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.
19. Platform Management
We reserve the right, but not the obligation, to:
- monitor the Platform for violations of these Terms and Conditions;
- take appropriate action against anyone who, in our sole discretion, violates the law or these Terms, including reporting such user to relevant authorities where appropriate;
- in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable any Contributions or any portion thereof;
- in our sole discretion and without limitation, remove or disable files and content that are excessive in size or are in any way burdensome to our systems;
- otherwise manage the Platform in a manner designed to protect our rights and property and to facilitate the proper functioning of the Platform.
If you believe something on the Platform is unlawful, infringes your rights or breaches section 13, tell us through the contact form. Say where it is, what is wrong with it and how we can reach you. We will look at every report, act on it where it is justified, and tell you what we decided.
Where we remove, restrict or refuse something you posted, we will tell you and give the reason, unless telling you would itself be unlawful. You can reply and ask us to look again, and we will answer within the period in section 29. This does not apply to content removed automatically as spam or duplicate submissions.
Nine Short Clauses Every Contract Ends With. Open the One You Need; Each Stays Quotable by Number
To the fullest extent permitted by applicable law, travelData.shop and its directors, employees, and Partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profit, revenue, data, or business opportunity, arising out of or in connection with the Service or the Platform, even if advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising out of or relating to the Service in any twelve-month period shall not exceed the amount you paid us for the Service giving rise to the claim in that period.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.
The Platform and the Service are provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the Service will be uninterrupted, error-free, or available in any particular location, at any particular speed, or on any particular device.
This disclaimer does not affect statutory guarantees that apply to consumers under mandatory law, including the right to a conforming service and the remedies in section 8.
You agree to defend, indemnify, and hold us and our Partners harmless from any claim, loss, or expense (including reasonable legal fees) made by a third party arising from your Contributions, your use of the Service in breach of these Terms or of applicable law, or your infringement of a third party’s rights. We may assume the exclusive defence of any matter for which you are required to indemnify us, and you agree to cooperate with that defence. This clause applies to consumers only to the extent permitted by mandatory law.
These Terms remain in force while you use the Platform or hold an account. You may close your account at any time from your account settings; plans already activated run to their end under section 3.3 and are not refunded on closure except as provided in section 8.
We may suspend or terminate your account and access to the Platform where you breach these Terms or where the law or a Partner requires it. Except where a breach or the law makes that impossible, we will tell you first and give you a reason.
Where we discontinue the Service, or close your account for a reason that is not your breach, we will give you reasonable notice and refund what you have not used: the unused part of any plan already paid for, any travelData Coins and promotional credit on your balance, and any gift card balance that has not been redeemed, to the payment method you used or by another means we agree with you. Section 7.6, which cancels a balance on closure, does not apply in that case.
Sections that by their nature should survive termination continue to apply — including sections 7, 8, 10, 11, 12, 14, 20, 21, 22, 25, 27 and 29.
We are not liable for any failure or delay in performing the Service caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, epidemics, government action, sanctions, labour disputes, failures of public networks or utilities, or outages at Partners and network operators. Where such an event prevents a plan from being delivered at all, section 8 applies.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets, provided that your rights under these Terms are not reduced as a result.
These Terms, together with the Refund Policy and any plan-specific terms shown at checkout, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings. The Privacy Policy is given alongside them under data-protection law rather than forming part of them, and section 12 explains why that distinction matters. Our failure to enforce any provision is not a waiver of it. Headings and the “In short” summaries are for convenience only and do not affect interpretation.
Using the Platform, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications from us, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically — by email or on the Platform — satisfy any legal requirement that such communication be in writing. You agree to the use of electronic signatures, contracts, orders, and records, and to the electronic delivery of notices, policies, and records of transactions initiated or completed through the Platform. This section is about how we reach you, not about advertising: it covers what we have to send you — your eSIM and its installation steps, receipts, notices under section 6, complaint decisions and changes to these Terms — and it does not, by itself, permit marketing email. The Privacy Policy says which messages are marketing and on what basis they are sent, and every one of them can be stopped from the message itself.
29. Complaints and Dispute Resolution
Complaints about the Service, a charge, or a refund must first be submitted to our support team through the contact form or the support channels in your account. Please include the order number, the email address of the account, the device model, whether the plan was activated, and a description or screenshot of the problem.
We will confirm receipt of your complaint in writing and decide on it without undue delay, and at the latest within 30 days of receipt. Where we need further information from you to investigate, the period runs from the day we receive it.
If you are not satisfied with our decision, or we do not answer within that period, reply and tell us why. We will review the complaint once more and give you a final written answer.
Nothing in this section limits your rights as a consumer. Whatever we decide, you keep the right to bring a claim before the competent courts under section 10.1, or before the courts of your country of residence where mandatory consumer law grants that right, and to use any dispute-resolution scheme available to you where you live.

17. Social Media
As part of the functionality of the Platform, you may link your account with third-party service providers (each such account, a “Third-Party Account”) by either: (1) providing your Third-Party Account login information through the Platform; or (2) allowing us to access your Third-Party Account, as permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent and warrant that you are entitled to disclose such information and/or grant such access without breaching third-party terms and without obligating us to pay any fees.
By granting us access to any Third-Party Accounts, you understand that (1) we may access, make available, and store certain content you have provided to and stored in your Third-Party Account (the “Social Network Content”) so that it is available on and through the Platform, and (2) we may submit to and receive from your Third-Party Account additional information to the extent you are notified when you link accounts. If a Third-Party Account becomes unavailable or our access is terminated, the Social Network Content may no longer be available on and through the Platform. You can disable the connection between the Platform and your Third-Party Accounts at any time. Your relationship with third-party service providers is governed solely by your agreement(s) with them. We are not responsible for Social Network Content.
